New Delhi: The Delhi high court on Friday asked AAP government to find out how other states have implemented Protection of Children from Sexual Offences (POCSO) Act in the context of pendency and number of prosecutors trying these cases. A bench of Chief Justice G Rohini and Justice Sangita Dhingra Sehgal also called for data from the 11 designated special POCSO courts in the capital on pendency since 2012 and the extent to which prosecutors are able to cope with the cases.
HC issued the directions while hearing a PIL of advocate Gaurav Kumar Bansal alleging lack of enough dedicated public prosecutors in special courts handling POCSO cases.
“Delhi government should provide data regarding what is the practice followed in other states under POCSO Act. Submit report of designated special courts (Delhi) their functioning and pendency of cases and whether the public prosecutors attached to that court are able to cope up with the recording of children in 30 days and disposal of the cases within one year of taking cognisance of chargesheet as provided under the Act,” the court said and listed the matter for further hearing in September.
